This Privacy Policy describes how Yac Inc. ("Yac," "we", "us" or "our") handles personal information that we collect through our websites and mobile applications that link to it, including the Backtrack app described at usebacktrack.com (collectively, the “Service”), as well as through our marketing and other activities described in this Privacy Policy. 

PLEASE NOTE: IF YOU SUBSCRIBE TO THE SERVICES FOR A SUBSCRIPTION TERM, THEN YOUR SUBSCRIPTION AND THIS AGREEMENT WILL BE AUTOMATICALLY RENEWED FOR SUCCESSIVE BILLING PERIODS AT OUR THEN-CURRENT PRICING FOR SUCH SERVICES UNLESS YOU OPT OUT OF THE AUTO-RENEWAL IN ACCORDANCE WITH SECTION 7 BELOW.

PLEASE NOTE: THAT SECTION 15 OF THIS AGREEMENT CONTAINS AN ARBITRATION AGREEMENT THAT REQUIRES MOST DISPUTES BETWEEN US TO BE RESOLVED ON AN INDIVIDUAL, NON-CLASS ACTION BASIS THROUGH BINDING AND FINAL ARBITRATION INSTEAD OF IN COURT. SEE SECTION 15 FOR MORE INFORMATION REGARDING THIS ARBITRATION CLAUSE AND HOW TO OPT OUT.

Backtrack app users: When you use the Backtrack app, note that recording: 

  • begins as soon as you grant the app access to your microphone; 
  • remains in progress at any time the red dot at the top of the app is flashing or the app indicates that recording is in progress; 
  • does not stop when you navigate to other screens or apps; and
  • can be transcribed only for the “backtrack length” specified in your settings but recordings may be retained for the period described in the Security and Retention section below.

Introduction

Yac Inc. ("Yac," "we", "us" or "our"), our service providers, and advertising partners use the following technologies to automatically collect information through our websites and mobile applications, including the Backtrack app described at https://usebacktrack.com/ (collectively, the “Service”) and in connection with our marketing activities:

  • Cookies.   • Pixels.   • Software development kits, or SDKs.  These are used to incorporate third party computer code into our Service that allows our service providers or advertising partners to collect data directly from our Service for a variety of purposes, including to provide us with analytics regarding the use of our Service, to add features or functionality to our Service, or to facilitate and measure the effectiveness of online advertising.
  • Session replay. We use third party software code to record users’ interactions with the Services in a manner that allows us to watch and analyze visual reconstructions of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements, scrolls, and keystrokes/key touches during those sessions.   • Chatbot features.  The Service provides users with chatbots that users can use to get information and support. We and the third parties that support these features monitor and record the information you submit to the chat to enable the chat and for the other purposes described in our Privacy Notice. When you use these features, you are not communicating with a human.
